Legal Notes and General Conditions of the Contract


1. Scope and object of the contract.


1.1. These General Contract Conditions govern the relationship between B&B Villa Eugenia (hereinafter “B&B”) and the Customer regarding the provision of accommodation services chosen by the Customer in the booking proposal made from among those offered by the Facility, viewable on the website www.bbvillaeugenia.com or on the website https://villaeugenia.bookingturbo.com/it/ .


1.2. The Customer may request the provision of Services by submitting a Booking Proposal to the B&B by: sending an email to isabella@bbvillaeugenia.com or cherimoi@tiscali.it; verbally by telephone at  39 3387243893; or using the online booking procedure on the website.


1.3. The contract is deemed concluded when the Customer submits the Booking Proposal as described in point 1.2 and brings it to the attention of the B&B. The actual conclusion of the contract is always subject to the availability of the Service. This confirmation is provided by the B&B upon receipt of the Proposal or immediately thereafter.

1.4. If the activation of the Services cannot occur due to impediments not attributable to the B&B, the contract will be automatically terminated, without this entailing any liability of the B&B towards the Customer.


2. Activation and provision of the Service.


2.1. Upon activation of the Service, the B&B guarantees the Customer:

– the enjoyment of furnished housing units (hereinafter “Rooms”), in the number and type defined in the Proposal.

– breakfast, the possibility of using outdoor spaces, internet connection, weekly cleaning and linen change, and all the services required by current regional law regarding B&Bs.

2.2. The B&B will provide the Customer with any other accessory equipment required for full use of the selected Services (keys, cards, etc.) on loan for use.

2.3. The Customer shall use the rooms, common areas, and equipment in a manner that does not disturb the normal operation of the Service or any third parties staying in the B&B facilities. The Customer shall be solely liable for any direct damages resulting from the violation of this obligation, holding the B&B harmless from any consequences, costs, or charges.

2.4. The Customer will indemnify the B&B from any prejudice, damage, liability, expenses, including legal expenses, suffered or incurred by the B&B. The Customer will also indemnify the B&B from any action, reason, or claim brought against it by third parties that are caused or motivated by behavior and/or omissions attributable to the Customer or are in any case a consequence of non-compliance and/or violation of the provisions set forth in these General Contract Conditions.


3. Booking and Payment.

  

3.1. In the case of a reservation for a future date, the B&B requires the Customer to pay the amount due one week in advance of the first day of arrival and overnight stay.

3.2. Failure to pay the amount due within the above terms will result in the cancellation of the reservation, without any need for any communication from the B&B.


4. Duration of the Contract, cancellations and penalties.


4.1. The Contract is valid and effective from the date of conclusion of the Contract itself and ends if both of the following conditions are satisfied:

– the Client and third parties connected to him, or dependent on him, have permanently left the B&B accommodation facility;

– the Customer has paid the full amount due to the B&B.

4.2. Check-in is between 5:00 PM and 7:00 PM. It is not possible to use the entire property before this time. Any late arrivals must be arranged in advance with the B&B. Failure to notify the B&B may result in long waits, for which no complaints or refunds will be accepted. Check-out is strictly between 7:00 AM and 11:00 AM. Failure to do so will result in an additional night's stay.

4.3. The Customer has the right to cancel the reservation and terminate the contract within the timeframes set out in point 3.1. No refund will be provided to guests who leave the B&B early, regardless of the reason.


5. Privacy protection.


5.2. The Customer is informed, pursuant to Article 13 of Legislative Decree no. 196/2003, that the processing of personal data provided to the B&B is necessary to allow the B&B, directly or through third parties, to fulfill the obligations arising from this contract or to fulfill the obligations established by law or regulations.

5.2. The data controller is the legal representative of the B&B.


6. Documents.


6.1. Upon arrival at the B&B, guests must present valid identification documents (passport, identity card) required for registration as required by current legislation. Failure to comply with this requirement constitutes a violation of the Criminal Code and entitles us to request immediate departure from the B&B. Our guests' data is processed in accordance with current privacy legislation.


7. B&B Responsibilities.


7.1. The B&B will be responsible for breach of contract and for the provision of the Service exclusively for reasons attributable to it.

7.2. If upon arrival the Customer finds a Service different from the one agreed upon but accepts it anyway, he/she will automatically be deemed to have forfeited any right to compensation and the new Service will replace, by agreement of the parties, the one previously agreed upon.


8. Limits of liability.


8.1. The B&B will not be responsible for delays, inconveniences, malfunctions and/or interruptions of the Service due to:

– fortuitous event or force majeure;

– tampering or interventions on the service or equipment carried out by the Customer or by third parties not authorised by the B&B;

– damage or inconvenience caused by the total or partial interruption of the electricity or water supply;

– The B&B will not be responsible for valuables owned by guests and brought into the facility.


9. Management recommends:


 9.1. Silence/Children. Total silence must be observed from 11:00 PM to 8:00 AM and from 2:00 PM to 4:00 PM. Access to the B&B's private areas (kitchen and living room) is prohibited. Children must always be accompanied by an adult. In any case, guests must maintain a behavior that does not disturb the tranquility of others at any time of the day or in any way.


 9.2. Cleaning. Rooms are cleaned weekly. Rooms must be vacated by 10:00 a.m. for cleaning. If rooms are not vacated by 10:00 a.m., cleaning will be postponed until the following day. Please arrange your belongings so that this cleaning can take place.


 9.3. Other Guests. It is strictly forbidden to bring other guests into the room, onto the terrace, or into any area of the B&B without the manager's authorization, under penalty of a €250.00 surcharge. The guest may not sublet or loan the room, in whole or in part, under penalty of cancellation of the reservation fee and a €250.00 surcharge.


 9.4. Breakfast. Breakfast can be enjoyed between 8:00 and 11:00.


 9.5. Smoking/Weapons/Drugs. Bringing weapons, narcotics, and other substances into the property is strictly prohibited. Failure to do so will result in immediate termination of the contract. Smoking in the rooms is also strictly prohibited. Smoking is permitted on the terrace, but please use the ashtrays provided.


 9.6. Kitchen. Use of the kitchen is not permitted.


 9.7. Personal Items. Items of any kind may not be left in the corridors or common areas. The B&B is not responsible for personal items left unattended. NB: We decline all responsibility for the loss, theft, or damage of your personal items left unattended in rooms.


 9.8. Animals. It is strictly forbidden to bring animals of any kind or size into the breakfast room during meal times.


 9.9. Sense of modesty. It is strictly forbidden to wander around the B&B wearing clothing that might offend the decency of others. In any case, the Guest is prohibited from engaging in acts or behaving in a manner that might disturb other residents of the building.


 9.10. Restrooms. We recommend proper and civil use of the restrooms, avoiding throwing anything in the toilet (use the designated bins).
